In Plain Language
These are the rules of buying from us and using our website. Quick version:
You can change your mind: By law you have 7 days after delivery to cancel an online order for any reason (the "cooling-off" right).
Hygiene exception: For hygiene reasons, bras must be returned unworn, with tags still attached, in original packaging. We can't accept returns of worn or washed items.
If something's wrong with the bra: You're protected for 6 months under the Consumer Protection Act. Contact us, we'll repair, replace, or refund.
Delivery: 2–7 working days nationwide. Tracking always provided.
1. About Us
This website (brasbymamloo.co.za) is owned and operated by Bras By MaMloo, based in Ladysmith, KwaZulu-Natal, South Africa.
By using our website or placing an order, you agree to these Terms & Conditions. If you don't agree, please don't use the site or place an order.

2. Placing an Order
When you place an order through our website:
- You make us an offer to buy the products in your cart at the displayed prices.
- We send you an order confirmation email — this is just a receipt, not yet acceptance.
- Your order is accepted when we send you a dispatch confirmation. That's when the contract is formed.
We may decline an order at our discretion — for example, if a product is out of stock, if there's a pricing error, if we suspect fraud, or if delivery to your area isn't available. If we decline, we'll refund any payment in full.
Order accuracy
Please double-check your order details (sizes, quantities, address) before checkout. Once an order is dispatched, we may not be able to change it.
3. Prices
All prices are in South African Rand (ZAR) and are VAT-inclusive where applicable. Delivery fees are shown at checkout before you pay.
We try to keep prices accurate, but mistakes happen. If a product is listed at a clearly incorrect price (e.g. R10 for a R500 bra), we reserve the right to cancel the order and refund you in full. We'll always contact you first.
4. Payment
We accept the following payment methods at checkout:
- Credit & debit cards (Visa, Mastercard) via Yoco — secure, PCI-DSS-compliant processing
- Instant EFT via Yoco
- Manual EFT — banking details and a unique payment reference are provided after checkout. Order is dispatched once payment reflects in our account.
Important — Manual EFT safety: Banking details are only ever shared with you on the password-protected order confirmation page after checkout. We will never send banking details by email, WhatsApp, or SMS. If anyone (including someone claiming to be us) sends you new or different banking details, please contact us directly via the WhatsApp numbers above to verify before paying.
No COD
For your security and ours, we don't offer cash-on-delivery. All payments are completed before dispatch.
5. Delivery
We deliver nationwide via:
- The Courier Guy — door-to-door, 2–4 working days
- Pargo — collect from a Pargo Point near you, 3–5 working days
- PUDO — locker-based delivery, 3–5 working days
- PAXI — collect from a PEP store, 5–7 working days (cheapest option)
Delivery times start from when we dispatch your order, not from when you place it. We aim to dispatch within 1–2 working days of receiving payment.
Delivery fees are calculated at checkout based on your address and the courier you choose.
Risk passes to you on delivery. Please inspect your parcel on arrival. If anything looks damaged, take a photo and contact us within 24 hours.
6. Your Cooling-Off Right
Under the Electronic Communications and Transactions Act (ECTA) section 44, when you buy from us online you have the right to cancel your order within 7 working days of delivery, for any reason, without penalty.
To exercise your cooling-off right:
- Email or WhatsApp us within 7 working days saying you'd like to cancel.
- Return the products to us in their original, unworn, untagged condition within a further 7 working days.
- We'll refund the purchase price within 30 days of receiving the returned goods.
Hygiene limitation: Under ECTA section 42(2)(d), the cooling-off right does not apply to goods that, by reason of their nature, cannot be returned. For hygiene and health reasons, this means we can only accept cooling-off returns of bras that are unworn, with all tags still attached, in original packaging, and not soiled or damaged.
Return shipping cost: Under ECTA, the only charge we may make is the direct cost of returning the goods. Please use a tracked courier service.
7. Returns & Exchanges (Beyond Cooling-Off)
Outside the 7-day cooling-off window, we still want you to love what you buy. Here's our standard returns policy:
Size exchanges
If a bra doesn't fit, you can exchange it for a different size within 14 days of delivery, provided it's unworn, with tags attached, in original packaging. Return shipping is at your cost; we cover the cost of sending the replacement.
Defective items
If a bra has a manufacturing defect, the Consumer Protection Act section 56 gives you a 6-month window to choose between a repair, replacement, or refund — at no cost to you. Contact us with photos and we'll sort it out.
What we can't accept
- Worn or washed bras
- Bras without tags or original packaging
- Bras returned more than 14 days after delivery (except for defects covered by CPA)
- Items marked "Final Sale"
8. Quality & Implied Warranty
Under CPA section 55–56, you have an automatic right to receive goods that are:
- Of good quality, in good working order, and free of defects
- Useable and durable for a reasonable period
- Compliant with any applicable standards
This applies for 6 months from delivery. We honour these obligations fully and won't try to limit them. Nothing in these terms reduces your rights under the CPA.
9. Pop-Up Fittings & Bookings
When you book a fitting:
- Bookings are first-come-first-served. Confirm details (date, time, location) via WhatsApp.
- Fittings are conducted in private, comfortable spaces. Where possible, fitters wear gloves.
- You're not obligated to buy. The fitting is to help you find your size.
- If you're under 18, please be accompanied by a parent or guardian.
- "Bring Us To Your Area" requires a minimum of 20 confirmed clients.
If you need to cancel, please give us at least 24 hours' notice via WhatsApp.
10. Limitation of Liability
To the maximum extent permitted by South African law:
- Our total liability for any claim arising out of an order is limited to the amount you paid for the products in question.
- We're not liable for indirect, consequential, or special damages (e.g. loss of profit, loss of opportunity).
- We're not liable for delays caused by events outside our reasonable control (e.g. courier strikes, load-shedding, severe weather, system failures at third-party providers).
Nothing in these terms excludes or limits liability where the law does not allow exclusion or limitation — including liability under the CPA for defective goods, liability for death or personal injury caused by negligence, or liability for fraud.
11. Disputes & Governing Law
These terms are governed by South African law. Any dispute that we can't resolve directly will be heard in the South African courts.

Before any formal action, please contact us. We're a small team and we genuinely want to help. Most issues are resolved within a few days via WhatsApp.

If we can't resolve your complaint, you may refer it to the Consumer Goods and Services Ombud:

12. General Terms
Changes to these terms
We may update these terms from time to time. The version in force is always the one published here. The "Effective" date at the top tells you when the current version took effect. Material changes are emailed to active customers.
Severability
If any part of these terms is found unenforceable, the rest remains in force.
No waiver
If we don't enforce a particular term on a particular occasion, that doesn't mean we've waived our right to enforce it later.
Entire agreement
These terms (along with our Privacy Policy and Cookie Policy) make up the entire agreement between us regarding your use of the website and any orders.
